Official Rules for the Crecera Mentorship Program Competition

The Crecera Course Competition (the “Competition”) is in no way sponsored, endorsed, or administered by, or associated with Instagram (“Instagram”) (the “Competition Platform”).

You understand that you are providing your information to the Sponsor (defined below) and not to Instagram.

The information you provide will only be used for the administration of this Competition and in accordance with the Sponsor’s privacy policy (see below).

Instagram is hereby completely released of all liability by each entrant in this Competition.

Any questions, comments, or complaints regarding the Competition must be directed to the Sponsor and not to Instagram.

You may only use one (1) Instagram Account (“Platform Account”) to participate in this Competition. In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Competition.

  1. Promoter:
    The promoter of this Competition is Crecera Pty Ltd and the Sponsor of this Competition is Crecera Pty Ltd.

  2. Eligibility:
    The Competition is open only to legal residents of Australia who are at least eighteen (18) years old at the date of entry and have a Platform Account and who otherwise meet the requirements set out in these Official Rules. If you do not have an Instagram Account, visit http://instagram.com and register in accordance with the enrollment instructions for a free Account. Employees of the Promoter or Sponsor, their subsidiaries, affiliates, prize suppliers, and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings, and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.

  3. Competition Period:
    The Competition Period begins at 9am AEST on Monday, March 24, 2025, and ends at 5pm AEST on Friday, April 11, 2025. Entries submitted before or after the Competition Period will not be eligible. Promoter’s computer is the official time-keeping device for the Competition.

  4. How to Enter:
    This Competition is a game of skill. To enter the Competition, you must, at any time during the Competition Period, complete the following:

i. Visit https://www.instagram.com/crecera.au/ and follow the page;
ii. Locate the competition post;
iii. Like the competition post and place a comment in which you tag the Instagram handle of a friend. When entering on Instagram, ensure your profile is set to public for your entry to be valid.
iv. Fill out the form at www.crecera.com.au/mentorship-program. 

IMPORTANT NOTE: Standard text messaging, data, and/or other rates apply to participants who submit a Post via a wireless mobile device. Wireless service providers may charge for airtime and/or data in relation to each standard text message sent and received. Please contact your service provider for pricing and service plan information and rates before mobile device participation.

  1. Limit:
    There is no limit on the number of entries during the Competition Period. Entries generated by script, macro, or other automated means are void. Uploading an Entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such entries in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media, or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry. Released Parties (as defined below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed, or misdirected Entries; all of which will be void. The entrant further agrees, represents, warrants, and guarantees to Promoter that:

a. They have and will maintain all necessary rights, consents, approvals, authorisations, licenses, and rights in and to all Entries and all information they contain in order for Promoter and its sublicensees to use the Entries and exercise the rights granted herein;
b. The uploaded Entry does not include photos or information about children or any third parties without their consent (or a parent or legal guardian’s consent in the case of a child under 16 years of age);
c. If the Entry contains any personal data of individuals, the entrant agrees, warrants, and represents that they have obtained consent of these individuals for (a) their likeness and/or personal data to be included in the Entry; and (b) the collection, disclosure, transfer, processing, and use of their personal data by the Promoter in accordance with these Terms and Conditions and the Promoter’s Privacy Policy.

  1. Competition Draw:
    There will be one (1) winner with respect to this Competition, unless otherwise decided. The winner(s) will be selected based on the creativity and quality of their entry as determined by a panel of judges appointed by Crecera Pty Ltd. The judging will take place on Wednesday, April 16, 2025. The entrant with the most compelling and innovative entry, as determined by the judges, will be awarded the Prize. The Promoter will notify the winner(s) within two (2) business days of the prize draw, via the email address submitted with their entry. The Sponsor may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants).

  2. Sponsor’s Rights to Submissions:
    By entering, you grant Promoter, Sponsor, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party. You agree that the Promoter may use the aggregate information collected from the competition for related research and marketing purposes. Participants warrant that their entry is their own work.

  3. Potential Winner Requirements:
    The potential winners may be required to submit to the Promoter and Sponsor their first name, last name, age, email address, and proof of ownership of winning Platform Account in order to redeem the Competition prize.

  4. Prize:
    There is one (1) prize to be won. One (1) winner will receive a prize of one (1) six-month mentorship program. Approximate retail value of the Prize: $6,127 AUD. Total Competition prize value is $6,127 AUD. Any difference between the stated value and actual value will not be awarded. The Prize is a single-use coupon and is valid for redemption by April 28, 2025. The mentorship is available for unlimited access by the winner for six months. Any prize details not specified above will be determined by Sponsor, at its sole discretion. Winners may not transfer, assign, or substitute the Prize, or redeem the Prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value. The Prize must be accepted as awarded. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by Sponsor. The Prize will be provided by the Sponsor. Specific Prize details are at the discretion of the Sponsor. Winner is responsible for all other unspecified costs related to their Prize.

  5. Unclaimed Prizes:
    In the event the prize winner fails to claim his or her prize by April 28, 2025, or if after making reasonable attempts the Promoter cannot contact the winner (or the winner does not contact the Promoter), the prize winner will be deemed to have forfeited the Prize and will not be entitled to any supplementary prize or benefit. The Promoter will re-award the relevant prize to a Reserve. Any winner will be informed in writing within 2 days of determination. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.

  6. General Conditions:
    In the event that the operation, security, or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) award the prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsor by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsor (as applicable). The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited. Where there is a dispute between you and Promoter and/or Sponsor regarding the conduct of this promotion or claiming a Prize, the Promoter and/or Sponsor will endeavour to resolve the dispute with you. If the dispute cannot be resolved, the Promoter and/or Sponsor’s decision in connection with all aspects of this competition is final.

  7. Collection and Use of Your Personal Information:
    Sponsor may collect your personal information directly. We will use your personal information as necessary in order to conduct and manage the Competition, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this competition, communicating with you, or storing data. This may include disclosures to organisations outside Australia in places such as the United States.

  8. Use of Winner’s Information:
    By entering this Competition, the winner agrees to the use of their name, likeness, image, and any other relevant details provided during the entry process for promotional, marketing, or advertising purposes. The winner also agrees to participate in reasonable publicity activities associated with the competition without additional compensation, unless prohibited by law.

  9. Release and Limitations of Liability:
    Nothing in these terms and conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth). Without limiting the previous paragraph, by entering, you agree to release and hold harmless the Promoter and Crecera, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact your entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

  10. Disputes:
    Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Queensland, Australia. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of Queensland, Australia, without giving effect to any choice of law or conflict of law rules (whether of QLD or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Queensland, Australia.

  11. Results:
    The winner will be announced within 2 business days of the prize draw on the following website and displayed for a period of 28 days.
