Crecera VA Services: Terms & Conditions
Effective upon purchase via the Crecera Kajabi checkout.
These Terms & Conditions (“Agreement”) govern the purchase and use of Virtual Assistant (“VA”) services provided by Crecera Pty Ltd (ABN 14 678 829 368) (“Crecera”, “we”, “us”).
By completing a purchase, the Client (“you”, “the Client”) agrees to these Terms & Conditions in full.
1. Overview of Services
Crecera provides managed Virtual Assistant and implementation support services under a weekly subscription model.
Services include tasks outlined on the relevant product page at the time of purchase.
By purchasing a Crecera VA package, the Client is engaging Crecera to deliver support through one or more independent contractors selected and supervised by Crecera.
Crecera VA services are not a staff hire arrangement or employment placement service.
2. Assignment & Replacement of Virtual Assistants
2.1 Crecera retains full discretion in assigning a suitable contractor to the Client based on skills, availability and service requirements.
The Client is not contracting a specific individual.
2.2 Contractors may be changed, reassigned or replaced by Crecera at any time to ensure continuity, performance and appropriate coverage.
2.3 If a contractor resigns, becomes unavailable, or underperforms, Crecera will source, vet and onboard a replacement at no additional cost.
2.4 The Client agrees that changes in contractor personnel do not constitute grounds for termination, refusal to pay, refunds or disputes.
3. Weekly Package, Hours & Service Delivery
3.1 The Client purchases a weekly package with a fixed number of hours at a fixed weekly rate, as displayed on the product page.
3.2 Service delivery is managed across the week; hours are not linked to daily attendance or fixed shift times.
3.3 Unused weekly hours do not roll over unless explicitly stated.
3.4 Services commence once the first payment has cleared and an onboarding call/form has been completed.
3.5 Crecera may pause services if payments fail, fall overdue or if the Client does not provide adequate access or instructions.
4. Leave, Availability & Service Continuity
4.1 Planned Leave:
Contractors provide Crecera with a minimum of 2 weeks’ notice for planned leave. Crecera will notify the Client as soon as practicable and arrange:
- catch-up hours,
- temporary support, OR
- suitable adjustments.
4.2 Unplanned Leave (Illness/Emergency):
Crecera will notify the Client promptly and ensure reasonable continuity measures.
4.3 Crecera is not liable for delays caused by Client non-responsiveness or access issues.
5. Scope of Work & Role Limitations
5.1 Implementation Support Only
Crecera Virtual Assistants are implementation-focused. They provide operational, administrative, creative and marketing support tasks as directed by the Client.
5.2 Not Strategists or Advisors
VAs do not provide strategicor advisory services, including but not limited to:
- marketing strategy
- brand strategy
- campaign planning
- content strategy
- financial or tax advice
- business coaching
- managerial decision-making
- analytics interpretation
- performance analysis
unless explicitly contracted under a separate written agreement with Crecera.
5.3 Client Remains Responsible for Strategic Direction
The Client retains full responsibility for:
- all business decisions
- marketing strategy
- content direction and approval
- advertising choices
- budgets
- compliance with legal or platform requirements
- brand and risk management
5.4 No Performance Guarantees
Crecera makes no guarantee of any business performance outcome, including:
- sales
- leads
- engagement
- marketing growth
- visibility
- algorithm performance
- revenue improvements
- campaign results
All outcomes are influenced by factors outside Crecera’s control.
5.5 No Independent Decision-Making Authority
VAs are not authorised to:
- approve or publish content without Client sign-off
- spend money on behalf of the Client
- initiate advertising
- make legal, financial or risk-based decisions
- commit the Client to obligations
unless the Client provides explicit written permission.
6. Client Responsibilities
The Client must:
- provide timely access, logins, instructions and approvals
- maintain security settings, MFA and system protections
- use unique logins (no sharing of master credentials)
- ensure briefs and guidance are clear
- supervise strategic direction
- comply with all security and confidentiality obligations
Failure to provide adequate access, instructions or approvals may delay or limit service delivery without affecting billing.
7. Security, Access & Confidentiality
Crecera maintains strict confidentiality protocols.
Contractors are vetted, trained and bound by confidentiality and data protection undertakings.
The Client agrees to comply with Crecera’s Security & Access Guidelines, including:
- using unique logins
- limiting permissions to role requirements
- revoking access within 24 hours upon termination
Crecera is not liable for losses arising from Client-managed systems, data access or platform vulnerabilities.
8. Non-Solicitation
The Client agrees not to directly or indirectly hire, contract, engage or approach any Crecera contractor introduced through Crecera during the engagement or for 12 months after termination.
A breach of this clause incurs a placement fee equal to six (6) months of the expected service value.
9. Payments & Billing
9.1 All packages are billed weekly via subscription at the rate shown on the product page.
9.2 Payments are due automatically through the checkout method selected.
9.3 If payment fails or is paused, services will be suspended until resolved.
9.4 No refunds apply to time already allocated, delivered or reserved for the Client.
10. Term & Termination
10.1 Minimum Term:
- First 3 months: 14 days’ written notice
- After 3 months: 30 days’ written notice
10.2 Cancellations inside Kajabi stop future automated billing only; termination notice fees remain payable.
10.3 Termination does not relieve the Client of outstanding fees or notice obligations.
11. Liability & Indemnity
Crecera is not liable for:
- indirect, incidental or consequential losses
- business disruptions
- performance outcomes
- platform or system failures
- Client decisions or strategic misdirection
The Client indemnifies Crecera for losses arising from access provided, instructions given, or misuse of platforms.
12. Dispute Resolution
Parties agree to resolve disputes in good faith.
If unresolved, disputes must proceed to mediation prior to legal action.
This Agreement is governed by the laws of Queensland, Australia.
13. Entire Agreement
This Agreement, together with product inclusions listed on the purchase page and onboarding documentation, forms the entire agreement between Crecera and the Client.
By completing the Kajabi checkout, the Client acknowledges and accepts all terms.
